AN ORDER DIRECTING ALL LOCAL GOVERNMENT UNITS IN DAVAO DEL NORTE PROVINCE TO INTENSIFY THE IMPLEMENTATION OF THE MODIFIED GENERAL COMMUNITY QUARANTINE (MGCQ) IN THEIR RESPECTIVE AREA OF JURISDICTION AND PROVIDING AMENDATORY AND SUPPLETORY POLICIES AND GUIDELINES THEREFOR

WHEREAS, Section 16 of Republic Act 7160, also known as the Local Government Code of 1991 mandates the Local Government Units (LGUs), within their respective jurisdiction, to ensure and promote health and safety, maintain peace and order, and preserve the comfort and convenience of its inhabitants;

WHEREAS, the Coronavirus Disease (COVID-19) pandemic continues to be a serious public health threat around the globe leading to the disruption of social normalcy and immense economic downturn in every region it has pervaded;

WHEREAS, Presidential Proclamation 922, declaring a State of Public Health Emergency throughout the Philippines and Presidential Proclamation 929, declaring a State of Calamity across the country by President Rodrigo Roa Duterte has called on the urgency to every Local Government Unit (LGU) to put priority on the prevention of the virus outbreak;

WHEREAS, the Inter-Agency Task Force for the Management of Emerging Infectious Diseases has issued the IATF Omnibus Guidelines on the Implementation of the Community Quarantine as amended by IATF Resolution No. 38, series of 2020, which includes the Modified General Community Quarantine (MGCQ), among others;

WHEREAS, the Provincial Government of Davao del Norte issued Executive Order No. 42, series of 2020, as duly amended by Executive Order No. 44, series of 2020, placing all the cities and municipalities of Davao del Norte Province under Modified General Community Quarantine (MGCQ);

WHEREAS, there is now a rising threat of local and community transmission in several parts of the Province; and thus, the need to urgently take heightened measures to prevent further transmission of the COVID-19 in the Province;

NOW, THEREFORE, I, EDWIN I. JUBAHIB, Governor of the Province of Davao del Norte, by virtue of the powers vested in me by law, do hereby order the following:

Section 1. Declaration. All Local Chief Executives in Davao del Norte Province are hereby directed to strengthen the implementation of the Modified General Community Quarantine (MGCQ) in their respective area of jurisdiction;

Section 2. Amendatory Policies and Guidelines. The following items under Section 3 of Executive Order No. 42, series of 2020 are hereby amended accordingly, to wit:

1. Item 1 thereof is hereby amended to read as follows:

Wearing of face shield and face mask is required in all public places. Other minimum public health standards, such as but not limited to wearing of personal protective 
equipment, temperature checking, sanitizing, observing social distancing and not talking face-to-face without wearing a face mask and face shield shall be complied with at all times. All government and private offices/establishments shall strictly implement a “No Face Mask and Face Shield, No Transaction” Policy;

2. Item 2 thereof is hereby amended to read as follows:

Checkpoints in all entry points of Davao del Norte Province is hereby re-established as follows:

• J.P. Laurel, Panabo City to Lasang, Davao City (to include the barangays: Sta. Cruz, Maduao, San Roque, Dalisay, and Malativas, all of Panabo City)
• Brgy. Pandapan, Tagum City
• Brgy. Apokon, Tagum City –Maco, Davao de Oro boundary
• Brgy. Madaum, Tagum City-Maco, Davao de Oro boundary
• Brgy. Igangon, San Isidro- Laak, Davao de Oro boundary
• Brgy. Magwawa, Sto. Tomas
• Sitio Natulinan, Sto. Niño, Talaingod

3. Item 10.3 thereof is hereby amended to read as follows:

All public transport vehicles entering Davao del Norte Province are not allowed to load/unload passengers anywhere. Drop-off of passengers shall be terminal-to-terminal only;

4. Item 16 thereof is hereby amended to read as follows:

Curfew hours from 9:00 PM to 5:00AM is strictly implemented. Exempted from the curfew hours are members of the COVID-19 Crisis Management and Response Team, emergency vehicles, health workers, and those who are required to work within the curfew period;

5. Item 17 thereof is hereby amended to read as follows:

Purchase of liquors/alcoholic drinks is allowed from 9:00 AM to 5:00 PM, except to minors. However, consumption is strictly prohibited in public places, such as restaurants, cafeterias, bars, and the like.


Section 3. Suppletory Policies and Guidelines. The following items are hereby added to the policies and guidelines of the Modified General Community Quarantine (MGCQ), to wit:

1. Anyone who intends to enter Davao del Norte Province must secure their QR Code before they are allowed entry;

2. All private and public establishments are required to adopt and use the QR Code scanning in their respective places;

3. The use and implementation of the QR Code shall be governed by the policies and guidelines provided under Section 3 of Executive Order No. 53, series of 2020;

4. Workers whose residence is outside of Davao del Norte Province may be allowed to enter the Province for work provided that they pass through the QR Code scanning at the designated checkpoints. Provided further, that they shall not travel to other places other than their workplace and that they shall travel back to their place of residence immediately after the end of their work schedule;

5. Residents of Davao del Norte Province whose place of work is located outside of the Province may be allowed to travel for work provided that they pass through QR Code scanning at the designated checkpoints upon their return to the Province and that they shall not travel to other places other than their residence only;

6. Officials and employees of both the Local Government Units and Provincial Offices of NGAs within Davao del Norte Province are strictly required to observe the following:

6.1. Travel outside Davao del Norte Province may be allowed provided that upon their return to the Province, they shall undergo home quarantine for seven (7) days;

6.2. Attendance to seminars, trainings, conferences and the like outside of the Province is highly discouraged, otherwise Item 6.1 hereof shall apply. Attendance/participation to such activities through virtual platforms is highly encouraged;

6.3. Loitering during noon breaks is strictly prohibited. Employees are not allowed to share table with another employee during lunchtime;

7. All private gatherings, such as wedding and baptismal ceremony and reception, wake/burial shall be limited to a maximum of 25 people only. Attendees are required to observe social distancing and to wear face mask and face shield. Only Authorized Persons Outside of Residence (APORs) are allowed to attend;

Furthermore, all private gatherings such as the abovementioned must secure permission from the Local Government Unit who shall in turn, facilitate the downloading of the DavNor COVID-19 Contact Tracing System (DCCTS) QR Code scanning application to be used during the said event. Guests and visitors of the said event who are non-residents of Davao del Norte Province must secure their QR Code prior to attending the said event (Item 3.6 of Executive Order No. 53, series of 2020);

8. Wakes for the dead shall be allowed for a maximum of five (5) days only. Funeral services shall be limited to a maximum of 25 attendees only;

9. Conduct of public events and performances such as zumbas, live bands or karaokes in public places is strictly prohibited;

10. Other public events and community activities such as Araw ng Barangay Celebrations and Parochial/Patron Fiestas and Festivals are suspended;

1. Gambling activities such as derby/cockfighting is strictly prohibited. Property owners where the said gambling activity was held and barangay officials of the said locality who failed to implement this policy shall be held liable under applicable laws;

2. Eateries, restaurants, foodcourts, coffee shops including those inside the hotels and resorts are required to install plastic barriers in their common dining areas and provide plate-in services only;

Section 4. Declaration of Localized Enhanced Community Quarantine (ECQ) in High-Risk Areas of the Davao del Norte Province. Without prejudice to the implementation of the Modified General Community Quarantine (MGCQ) in the entire Province, Local Chief Executives may declare a Localized ECQ in high-risk areas in their city/municipality, i.e. purok-wide or barangay-wide ECQ to prevent further outbreak of COVID-19 to other low-risk areas. Such declaration should be in accordance with the omnibus guidelines provided by the IATF and subject to the approval of the Provincial Government;

Section 5. Separability Clause. If any provision of this Executive Order is declared invalid or unconstitutional, the other provisions not affected thereby shall remain valid and subsisting.

Section 6. Penalty Clause. Any violations thereof shall be dealt with under our existing laws, ordinances, rules and regulations.

Section 7. Effectivity. This Executive Order shall take effect on 03 November 2020 and shall remain in full force until 30 November 2020, unless revoked or amended.
